Hi All

I know a lot of July 2nd filers and some other who have been waiting for receipt notices...

There was an update yesterday by Mathew at www.immigration-law..that of the 800,000 applications only 400,000 have been receipted so far....May be it may take 2 more months for all the receipting updates to be done....

So everybody who is frustrated ..hang in there..have patience

10/11/2007: July VB Fiasco I-485 Receipting Delays

The USCIS has yet to release the detailed progress report on the receipting delays in terms of the numbers that have yet to be processed for receipting. The only thing people know through various private websites just indicates that there are a plenty of people who are still waiting for filing fee checks cashed or receipt notices received for the cases which were filed as early as July 2, 2007, not to mention any later cases.
We reported earlier that the USCIS had allegedly received total of 800,000 cases for the July VB fiasco cases. There is an unconfirmed report that they have completed the receipting only half way through of the total, meaning approximately 400,000. There are no sources of information to verify or confirm the figures. However, if it is correct, the USCIS has yet to process mountains of receipting workloads ahead and the filers have some additional sleepless nights which they will have to endure for a while. AMEN!

Anyone of you who has been fingerprinted and had interview with USCIS,

How long did you take to be given a schedued appointment for interview after the fingerprint? Did you have an interview right after the fingerprint?
Is that possible to have it both on the same day?
I am asking you because I would like to travel outside of the country with AP as soon as I have my fingerprint done.
If I would be nortified of the interview date right after the figerprint, I would rather stay to finish everything before travel. That way, I won't cause any troubles, right?

I'm sorry to hear about your mom's situation.

Obtaining the green card doesn't mean your mom has to come here immediately. She can attend the interview and choose to come at a later point. I'm not too familiar with the appointment process/wait times etc but it seems like a lot of hassle to have to reapply.

Is postponement of the interview a choice?

I dont know how long ago you obtained your green card or citizenship but these days it's a loooooooooooooooooooooong wait for the elusive GC. So grab your chance when it comes.

Yes you can apply for EAD and AP separetly anytime

The only catch I found out recently is that when you use AP to travel back to US, this may invalidate the H visa and you will need EAD.

I am still not clear of this issue. I applied for EAD few months ago and found out this may be an issue , so have applied for AP (By e-filing) now

Using AP to travel does not invalidate the H1...AP is just a travel document, and does not determine one's status in the country. The H1 would be invalidated only if the person switches to EAD.

This is the sort of news we should publicize.
Here is a clear example of business leaders moving ahead of the politics of this issue. It will have an impact on any sensible person.
It should get onto as many news wires as possible. Which sensible person can say that those 1000 high paying jobs going to Vancouver/Canada is in the interest of Seattle/USA. Imagine to spin off losses of this, to housing, to retail, to all sorts of areas of the economy where many Americans make their livelihoods.
This is what people don't understand, push them too far and capitalists will weaken the US economy.

Can you get second OPT doing a different Master's though you already had Master's. Did something change? The last I checked, you could get your second OPT only if you complete a higher degree like PhD than what you have.

The President has started revealing his plans on immigration for the next year. It sounds like he's planning on trying a do-over with Congress and attempting again to get a comprehensive immigration bill passed. He'll make the case for this in his State of the Union Address. I'm happy the President is still interested in working for change, I sincerely hope he is not making passing a reform bill his SOLE strategy. I'm reminded of Presidents in the past who regularly spoke in favor of something, but you just knew they didn't really care and were just trying to appease...

One of my favourite features in Flash is Trace Bitmap. I am currently trying to produce a print catalog and wanted to use this effect. I was wondering if there's any other programs that offer a similar feature, or otherwise what is the best way to trace a photo in flash and export it to another program.

Any help would be much appreciated.

It is possible to "interfile" in this situation, (See AFM Sec. 23.2(l) Transferring an Adjustment of Status Application from One Underlying Eligibility Basis to Another).

However, I do not think you can successfully interfile until your wife's 2010 PD is current. ( See AFM Sec. 23.2(l)(2)(L) The Priority Date must Be Current for the Basis to Which the Applicant Wishes to Convert).

Reciept notice should be recieved as soon as USCIS recieves the application. It shouldn't take much time though I kind of feel it should not take more than couple of days from USCIS part to send the reciept and then 4-5 days for postal reciept. I guess in about weekdays time after reciept at USCIS, you should recieve the notice.

This is just my understanding. Also some one said, you can start working for the new company as soon as your application is delivered to the USCIS. Get this confirmed by some one.

My spouse and myself are called for 485 initial interview, have couple of questions.

1) Do I need to take Affidavit of Support docs(form I 864), my 485 is employment based and not family based(I am the primary applicant)

2)Do I need to take Original I 140 and Original Labor approved doc

also please let me now if some one have been to such interviews and if there are any suggestion?

As long as you have the proof of marriage and related documents you are all set. Filing taxes as single or married has nothing to do with the GC application of the derivative .

Change of address is a slight point of concern so I would advise you to do it immediatly. Then everything should be all set. Make sure you have the same address on everything from now onwards - paystubs, bills etc which would be proof for future.
