I've written a number of times that we need to think about pursuing piecemeal immigration reform and give up on the notion of a comprehensive solution. The reason for this is simple math - you need Republican votes in the Senate to make it happen and the Republican Party has moved so far in to the Tea Party camp that it can't even muster a single pro-immigration voice. Lindsey Graham was that sole voice for much of 2009, but he walked away from the table in the spring and his latest pronouncements on the topic indicate that much like his...

Hi All
I have submitted my Indian passport for renewal at Houston Indian consulate via mail , its been close to a month I havent heard anything from consulate. I tried calling them up, no one attends the call.
Do you have any idea how can I speed up this process? Does personal visit to Houston consulate will help in speeding this up? Does passport submitted via mail can be handed over to me in person ?
Thanks
Ashish

Hi,
My PD is Dec-04 and I-485 filing date is Sept-07.
I changed my job in Aug-2008 and discontinued my H1B which is expired in Sept-2008. Now my only legal status is 'adjustment of status from H1B to Permanent Resident'. I think this is very common state most of the people waiting looong for GC fall into.
Now, I saw one of my friend's i-485 denied (with NO option to reopen!) bcoz an approved I-140 was not attached to this application. I agree that this is not simple mistake for USCIS can ignore, but there is always a 'very very remote' possibility that every application can be quetioned due to some flows in the filing.
Here is my question: Since I discontinued my H1B status and I am still in this country, can I apply for a fresh H1B? I am thinking because H1B quota is still open this year and to face any unexpected reason for 485 denial!
thanks in advance!

Can someone comment on how the recent trend has been for a PERM application that was applied under EB2 for a Software Developer position?
My employer is planning to apply one for myself and was wondering if it's a good time to do so?
I've heard that DOL is blatantly denying a large % of applications that are in the audit queue. Is this true? :(
Thanks

Cuban-born Emilio Estefan has been one of the most well-known residents of my home town of Miami since my childhood. He was a member of the famous band The Miami Sound Machine and in the years since he has become a highly successful Latin music producer in South Florida's music community. Estefan has been nominated for 28 Grammys over the years and won 14 times. He's also the husband of fellow band member Gloria Estefan. And he is the producer of well-known Latin music stars Marc Antony, Jennifer Lopez and Ricky Martin. And if life as a musician and producer...

Hi,
I am lawful permanent resident of United States, my I-130 is going to be expired on July, 2010, the last time I returned to United States was on October, 2009 and also depart on October, 2009.
I am now planned to return and live in the US for good on September, 2010, however by that time, my I-130 will be expired. Since my last time I left from US was on October 2009 and it is less than one year between the date I am going to return to US for good on September 2010. For this case, should I be fine by just holding just my green card to return to US for good.
Please kindly advise.
Thanks

During my last H1 transfer in 2008,LCA was filed for 60k per anum.LCA was filed in as work location Lanham,MD
Last Year ,my payroll ran for 90k per annum.
This year , my pay stub is running for 60k per annum. Still my Labor is for 60k only.
Will this be a problem when I am applying for Labor and at I140 stage in GC process?
Now If I am applying for H1b Extension, because of this drastic difference of 30k per anum,
will this be a problem.
please help me with answering this question.

I originally came here as an E2 dependant but my husband just walked out of his job and had his visa cancelled. My 1-94 is still valid but I am out of status due to reasons beyond my control. He is leaving to go to another country but I am desperate to stay here. As I am out of status, I can't apply for change of status but am scared that if I leave a re-apply for another visa I will be denied because I stayed here out of status..
Can anyone offer any advice? Really unsure of what to do..

Dear All,
Based on the lessons and experience gained from last Saturday demonstration in San Jose, we are organizing another protest this Saturday. A newly established yahoo group is working actively on preparing for this week's event.
We have been impressed with the participation from IV members. Please join the Yahoo group if you are in or near the San Jose area. Every bit of support and help is immensely valuable!

I am an American citizen. My Chinese wife of 3 years and I will move to St. Louis and buy a home there. She is a businesswoman and must return to China several times per year to take care of a business there. She will be applying for her immigrant visa very soon.
HOW MANY DAYS PER YEAR CAN SHE LEAVE THE US PER YEAR WITHOUT PUTTING HER IMMIGRANT VISA IN JEOPARDY?
Being a US resident is more important that the job, but we would like to do both, if possible.
I apprecite ANY advice formn knowledgeable people, including non-lawyers.

My spouse is out of country and she cannot comeback immediately since we are waiting for my H1 extension approval. Taking visa appointment days and airline availability in to consideration, she may not be able to make it back before end of july. I heard you can always add spouse later while 485 is still in progress. What are the implications if I go this path ?
