Hi,

Background filed H1 extension on Jan 2009 got approved Mar 2009, Got Approved I129 , Got the stamping H1B done in India. Online I129 status was still pending - Ignored that since I got the physical approval notice.

Feb 2009 changed Employer and started working on EAD, on June 3 the online status for I129 has been updated to Denied.
I am checking with my former employer to see if they withdrew my H1 (They typically don't withdraw H1).

I have not filed AC21 with my new employer.

Questions :

1. I have heard of online status still being in pending status even though its been approved. Have anyone heard of its getting denied ?. What are the implications ?.

2. There was a soft touch on my 485 on April 28. and i have not filed for AC21. Should i file AC21 ?

I am currently on H-1b and my wife is on H-4. My current job will be terminated on 8/15 and my wife has received H1b approval notice to start full time on 10/1. We have a US born baby who requires future post-surgery follow-ups. I was on F-1 visa, requested OPT through the university, but I didn't applied to USCIS, because I got H-1b premium processing approval. My wife has a valid H-4, and unexpired B1/B2 visa. So my questions are:

a) Between 8/15 and 10/1, are we out of status?

b) I should file a change of status. Should I file
(b-1) H-1b to H-4 directly (effective 10/1)?
(b-2) H-1b to B1/B2 (before 8/15), then B1/B2 to H-4 (effective 10/1)?
(b-3) H-1b to F-1 (before 8/15), then F-1 to H-4 (effective 10/1)?
(b-4) F-1 OPT with university endorsement, if they are willing to do it?

c) Do I need to go abroad and actually get B1/B2 visa since I never got one? I think a change of status should be okay.

Any suggestions are welcome. Thanks.

Hi folks,

My company filed for I-485 on July 2nd and I am yet to get a receipt for the same. I understand that usually it takes 1-3 months to get FP request after filing I-485 but in these circumstances, what should be the expectation for receiving FP request?

The reason for asking is because my wife is tired of waiting to do a job and is planning to go to India and work there until she gets EAD. If she leaves now and we get a FP request in her absence, what are my options?

1) Can I delay the FP appointment?
2) Can I go alone and have myself finger-printed (assuming that wife doesn't want to come back to US, that is, not interested in GC anymore)?
3) How does it impact EAD/AP which have not been filed yet but will be filed after getting the I-485 filing receipt.

USCIS has announced that it is working on a rule to create an electronic registration system for H-1B employers subject to the annual cap. Employers would first register an application and be allocated an H-1B cap number and then would file the case. Hi, I need your expertise, please help me. Following is my situation.

My EB3 labor priorty date was June 2003 was in pending, later same company filed in EB2 and I 140 got approved in Dec 2005.

I filed I 485 application in july 2007 and I applied in so hurry, I forgot to send a copy of I 140 approval as part of 485 filing. I got all the receipt notices.

My EB3 labor got approved before my 485 filing and I140 got approved this month

I would like to port the EB3 priority date. Please input your suggestions.

I have this thought. We start a letter campaign sending letters to all the house members: 1) To get them aware of Legal immigration and 2) To put our case fwd.

I feel it will be very effective as the flower campaign. Atleast most of us can participate in it, less expensive, less time consuming. And we can see why we wouldn't they respond to the bulk of mail they are getting every day.

I know we did letters through email etc. But i think sending through post will be different and they will be obligated to respond.

I do not know whether this is a good idea. so please dont rush at me.:)

Hi,
My wife's H4 was recently approved along with my H1. We both have different last names. My name is misspelled, an "a" missing and her middle initial is also different. What can I do to get a corrected H4? Can I go to local immigration office or something? My lawyer contacted the USCIS and they said they will respond in 45 days. They don't even guarantee that they will correct the approval document.
Please let me know

My I-140 got approved and priority date from EB3 got ported to EB2. I read in one of the forum threads that USCIS system would automatically identify that application is current and appropriate action will be taken. Also, I read about initiating interfile process of existing EB2 I-140 (current) with Pending I-485 application (under EB3). I am not sure whether I should wait few weeks before initiating interfile process.

I have given my biometrics in 2007 while filing I-485. Will USCIS send appointment for Biometrics again ?

Hello Gurus,
Can we apply for H1 if our I-485 is pending while the current status is L1.

The reason I am asking is I-485 is itself a COS and if we apply H1 while on L1 it is again an COS petition from L1 to H1. So what happens to the I-485 application?:confused:

Will there be any impact or no impact at all?:mad:

Is there an option to apply without asking for COS when applying H1 with the current status as L1.:confused:

Please help with your views....

Guys..
I am taking up a new job... The pay is good (10% more) and position is also of a senior lead developer.. I am not even leaving the area.. The company is 5 times bigger than my current one... I have an EAD card valid till Sept end 2008....What is your opinion. Should I go for the new offer? I am worried if anything will happen to my GC processing. Please help me make a decision..
