I have been arrested on Domestic Violence call by my wife ( of cource false allegations) about month back. Police investigation did not find any evidences and never sent file to DA for filing hence DA never filed charges.
Now USCIS requesting following

1) Please submit an arrest record and final court dispositions for each of your arrests. Court dispositions must be in the original and bear the stamp and/r seal of the appropriate court or clerk. If a court disposition or police record is not available, you must provide official or certified evidence from the appropriate law enforcement agency or court confirming the record in unavailable. Please note, these documents must either be the original or certified copy.

How to get court deposition or evidence that no charge are filed against this arrest?

I have filed petition for expunging arrest record but that will take a while to conclude.

Please advice what proof I can send to USCIS that this arrest did not even result in charges in court.

My in-laws got their visa at new delhi consulate on friday. they had appointment in english at new delhi. I had been looking for hindi appt dates at new delhi since june mid every day for 6-7 hours at morning and evening but could not get any hindi dates. Finally, had to book english dates on july 23 for july 30 appointment. here is my in-laws' experience:

first, they had a VO who asked them qs in english with accent. they were not able to understand a thing, so they requested him to ask qs in hindi after which he asked them to go to another counter where a young guy asked them qs in hindi. he was very polite and smiling all the time.

VO: Show me ur daughter's visa
we did not send them my wife's visa since i was sponsoring them.
Dad: We do not have daughter's visa. Here is son-in-law's visa

VO looked at the visa (I-797 and visa stamp copy), checked in computer for 4-5 mins and then asked
VO: Was it an arranged marriage?
Dad: Yes
VO: Tell me more about the process.
Dad: It was arranged marriage. My son-in-law's parents contacted us and then the girl and boy met each other and .....he described the process of arranged marriage.

VO smiled and asked: What do you do?
Dad: I am a businessman.
VO: What kind of business you do?
Dad told about his business

VO: Aapka Visa Manzoor ho gaya hai (Your visa has been approved).

Hi all,

I have a simple problem but can't get an anwer at the consulate because the person who's name is on the website to call is unbelievably rude even when I was very polite in asking 2 questions and calling him 'sir' all the time :(

I got my renewed passport yesterday and it doesn't contain my husband's name in the spousal name areal. So the problem is this:
1. I have applied for an H4 visa and I sent a copy of that application along as they requested.
2. All my proofs of residence were based on my marriage as the utility bill is in his name so there could be no confusion about the fact that I am married and the name of my spouse.
3. My address in India has been stated as my husband's address already but his name is not on the passport - is this really a problem?
4. I don't want to face any trouble when traveling as I'll be on an H4 with a passport that doesn't have hubby's name on it.

My question is:
1. Do I need to send anything else to them other than my new passport, an attested copy of my marriage certificate, and a $20 check for the return express mail?
2. Does the Washington DC consulate have an email address where I can submit a query as the two people listed on the website to call for passport problems do not seem to want to talk to anyone?
3. Can I possibly call the Chicago or SFO consulates to ask my questions as they seem to be better people (my hubby and brother got theirs renewed in these places)?

Please help!

But this time there are 90+ dems and Reps co-sponsored this bill..so chance of this getting passed is enormous and I was hoping since this is the child of those claiming to be the champions of the legal immigration ..could probably insert something to bring relief to the legal community..
Not sure though .. could not place hand on the text of this bill..

Hi all,

My h1 extension was denied recently even after 140 was approved and I filed for MTR...and am waiting for the receipt number...i am in my 5th year on h1b...and i did nor apply for 485 yet..

my employer/attorney also said i can be here for 180 days...

can i change my status to F1 - study visa during this period.

My h1b and i94 expired last month....april 13
what are the other options....

any leads will be helpful..

I applied for H1B cap exempt physician job on june 25th with my lawyer at vermont service center( wrong center by my lawyer's mistake) and my I-94 Expired on june 30. Vermont center lost or misplaced my file till july 22nd and when we send 2nd file with premium processing they found old file and forwarded it to california center and returned new file back to us. However california center placed recieved date as 22nd july. Later on the center asked for my medical license and that 22days out of status explanation. We send my license which was issued on august 23rd and explained about that 22days out of status. Finally they denied my petition just giving the reason that my license was issued later after my initial petition was filed meaning i was not eligilble for the job when i filed and cannot consider the evidence that came after in existence........now my question is
1-) in final decision they didnot mention anything regarding that 22days out of status issue
however mentioned that i filed on july 22nd.
so when now i go to consulate in india should i mention this 22days as out of status as overstay or still i am in status because i have my fedex reciept of sending my file on june 25th and final decision came on sept 15th. Need expert opinion guys ....thank you...

I see nothing wrong in it. It is an honor for India that our Mahatma Gandhi is remembered and associated with the biggest movement in USA. Gandhi did not get a Nobel prize but people who got nobel peace prize at that time are forgotten and he is not. There are bigger issues than talking about greencards in congress.

Hi,

I'm on L1B and wife on L2B with EAD and currently working. Both are expiring on Dec 30,2010. I got my H1 with COS, which is effective from Oct 01,2010 for 1 year and my wife got H4, effective from same time. My wife's company is filing for H1 for her and has already applied for LCA. After the LCA, they are not sure whether to apply for COS from L2 to H1 before Oct 1st or if they want to wait till Oct 1st and then file for new H1 with COS from H4 to H1. In the second case, she will not be able to work till she gets her H1.
Also if they file for H1 before Oct 1st with L2 to H1 COS, and if she gets RFE, then not sure whether the whole application is invalid as my wife's status would have changed from L2 to H4 during the course.


Please advice my options. Is it OK if her company file for new H1 with COS from L2 to H1 as soon as her LCA get approved with premium processing? Is it going to be a problem if she gets RFE?

Or is it adviseable to continue to be on L1/L2 till she gets H1? If yes, how can I change my status back to L1 before Oct 1st 2010? Can my company do it me? How long the process will take? I also heard that if I go abroad and come back, I will continue to be on L1. In that case should my wife acccompany me? Do I have to go out and re enter before Oct 1st?

If I change my status back to L1, what will happen to my H1? Will it still be valid? If I'm planning to change to a different company, can it be just transferred to that company and I can work there?

Please help.

Hi,

My I140 got denied early this year and the appeal is pending. Processing times for the appeal is 22 months. My priority date will be current next month. Because of that i am considering to refile my I140 and 485 again and withdraw the appeal.

1) Can we refile I140 with the same category (EB2)
2) Can USCIS just deny the new I140 because of the earrlier denial
3) Is there any one who tried this. What is the outcome of the new I140 application.

Please share your experience and also please advice

At the time of filing my application I just used one address.

Somehow I didn't know you could use Permanent address and current address.

You have used "one" address in I485, the same should be reflected in G325 - Consult with your lawyer.

I'm not sure but I guess my lawyer didn't file G325 form.
Is filing G325 form something mandatory ?

G325 is mandatory, if you or the lawyer has not sent to USCIS, you will get an RFE

I've moved recently.

I want to change the address now but want to give a new address (which is not the address I moved to .)

Should it be fine?

Just to be contrarian, I think the recent H1-B and L-1 fee increase is an opportunity. Instead of playing a victim of legislative abuse, we should come out batting with an offense. We should get businesses to lobby for us. We should get congress people educated about the unfairness. We should not say the fee is wrong, because these are after all elected officials and they will not jeopardize their election prospects by going against this measure. So we should say ok take this fee but then provide us with administrative fixes that we want.
