Guys,
I have been reading some posts since yesterday. I still haven't been able to get a confirmed clarification.
If I am on H1, and change my status on H4 for lets say 8 months. Then decide to start working again on H1, would I be counted against the cap again?
I have been reading some posts which says if I have been counted against the cap once in last 6 years, I won't be counted again. Does that apply when one changes visa status from H1 to H4, and then back to H1.
Has anybody done this successfully. Can you point to some clarification or law from USCIS itself?

Hello -
I am currently in US on L-1B that is expiring on June 15th 2010. I am planning to travel to India and return to US around May 10th. That will be around a month from the date my visa expires. My question is will I face any problems at the port of entry upon my return? I am needed on an assignment in US until Aug 2011 and so my employer is planning to file an extension as soon as I return to US.

I did not find a conclusive answer to my situation when i looked up multiple immigration forums.Hoping you folks can help.
My H1B expired on Jan 13th 2011 and my employer filed for extension on Dec 17th (Regular process) for Client A using LCA filed for City A. The case status is in initial review. Due to project reasons employer now wants me to move to City B for the same client. But my company's immigration dept have some reservations doing the relocation while the H1 extension is not approved yet.
1) Can we move to a location other than the one filed in LCA before the extension approval.
2) Can we use a already existing LCA for city B.( My company already has a Blanket LCA in city B). what is the relationship between the validity of the LCA and the H1 extension that is being requested in the petition.
3) Can we file a new LCA for city B. would this need a H1 amendment
4) Will any of the above options negatively impact my extension approval.

You have to renew your Donarship. Due to some probelm with IV Site, there is a problem.

When you start using EAD you will lose H1 status. You can do multiple jobs on ead but not on H1

then he got a H1 approved effective from Oct'07, with employer B.
but, he did not actually start working under employer B on H1 (payroll) until Mar'08.
he continued working under employer A on L1 ( has paystubs without any break) until Mar'08 and then worked with employer B on H1.
now he did a cap-exmpt H1 transfer to employer C, got H1 apporved and they are filing for GC labor PERM petition.
question is, while providing his previous employers info in the PERM petition,
can he say that he worked with employer A on L1 until Mar'08, even though his H1 with employer B is effective from oct'07?
appreciate any advice

I have filed two different I-140s for EB2-NIW (NSC, Nov 06)) and EB1-EA (TSC, march07). Both are pending at the moment. I wish to apply for I-485 now as the visa numbers are current in both categories.
I will appreciate if some one could advise if I can go ahead with the filing with pending I-140s. Also in that case can I file a single I-485 now and just ask it to be linked to whichever I-140 is approved first. will this work?
In this case whcih 140 number should I mention in my application and whcih center should I send the application to?

You should be able to contiue your GC without interruption even if you did not work for the sponsoring employer. but just make sure you are employed with the sponsoring employer before filing for I-485.
You may need a new H1 to go back to the previous employer. But GC should not be affected.

I'm presently in J-2 visa and my husband is having J-1 visa.
We both are Indian Nationals. My husband applied for J-1 visa when he was in Germany.
It is mentioned in my husband's Visa clearly that "Two Year rule does NOT apply".
3 months later, I applied for J-2 from India with his visa documents.
In my visa also, it is mentioned that "Bearer is NOT subject to section 212(E). Two Year rule does NOT apply".
Now, we both want to apply for H-1B visa seperately. I want to know whether do we need to apply for H-1B waiver?
It is very much confusing since we are Indian nationals, the two year rule applies. But at the same time, as he was in in Germany while applying, it does not apply as mentioned in the visa.
Please clarify. Thanks in advance.
