Not sure why you want to go to Consulate in India and why you have to mention to them about the 22 days. H1 will not be processed in the Consulate in India, it will be processed only here. If you are saying that in future when you go to the US Consulate in India for stamping then its not needed to mention about the 22 days, since you filed before the I-94 expiration. Do have a soft copy of the FexEx receipt saved for your future use.

First off, I know that people responding on this forum are spending valuable time answering my questions and very much appreciate the time you spend reading and responding to my requests.
I have the following situation:
1. Currently working on H1B, renewed effective Sep 15 2009 for the next 3 years (i.e. expires 2012 Sep)
2. I-485 filed in Aug 2007, PD of Jan 2006 for EB-2 / India.
3. Received and used Advance Parole in the past year or so to re-enter US (for spouse and me)
4. Have a valid EAD card that will expire October 2010. If relevant, spouse does not work, although she has an EAD card with same validity.
5. I accepted a job offer and expect to start work on Oct 5 2009 with the new company. The new job has a very similar description as the previous and is about the same level as well but higher pay.
My questions are as follows:
1. Should I request the new company to 'transfer' my H1B? What are the benefits and drawbacks of transferring the H1B as against switching to the EAD? What is the filing requirement for the transfer in terms of deadlines (i.e. do I need to have it filed on or before or within certain number of days after Oct 5?)
2. Will I be in violation of the AC-21 requirements ? What will I need to do to continue my GC process. The new employer has agreed to support the GC process and will do what is required.
3. In all this switchover, what documentation should I be requesting from my current employer's law firm? This is a big law firm and may take a few days to respond.
I need to be on point and keep pushing with the new employer as well as with the old one to make sure my legal status is not affected in the US. As such any additional tips / suggestions you have will be great too.
I have tried to provide as much detail as possible but please do let me know if I have missed anything. Again, thank you for your responses.

1. Would I be qualified to file for Writ of Mandamus (WOM)?
2. If I am qualified, would it be of any benefit for me to file WOM based on my criteria as

Thank you so much for your input .Right now I'm in a kind of predicament that my current employer told me in the middle of premium processing that he was hiring another person in my place.Then, when I spoke with my attorney he said we couldn't do anything in the middle of the process but to go ahead with it.I was approved for H1B 3 days after this incident.But, I have never worked for them since then and it's been a month trying to find another non-profit employer.So, in the midst of all this scenario, what would be the next alternative to be in the USA, how long I can be like this , I dont have a single pay stub, so can I show a reason that I was sick /or leave of absence when I find another job and include this kind of document with the peition or can do nothing for this period of time in the new petition.Could anybody please help me and Thanks in advance.

Dear Fellas,
I went for H1b Stamping a couple of months back. I was given a 221 g at that time and later on was asked for company's tax documents. During this time I did not hear any thing from US embassy in islamabad and got the same reply that my case was under administrative processing.
yesterday I received a letter from US embassy saying that my petition was returned to INS. The whole process has been very frustrating and I even left a couple of good offers hoping that H1b will get through anyways I guess its over for me now......
Did any one else face the same situation?? Will it do any good to reapply?

Sorry to hear about it. Don't get discouraged though, you will find new offers soon, just keep trying. Remember that persistence creates luck. About the reapplying for visa, I guess you should first talk to your company about it and then with the lawyers who helped prepare the documents. I guess, that'd be good place to start with. In the mean time, keep an eye on the opportunities in your home country. Good luck.

Please forgive me if these kind of posts are not allowed (Admins, feel free to remove this post if this is not the correct forum).
I am getting ready to apply for PIO for our new born (born in US) but one of my friend mentioned about applying for OCI instead.
The information on eligiblity for OCI in the NewYork consulate website is little confusing. My question is since me and my wife hold Indian passports, would my new born be eligible for OCI?
Also is there something called CIO (Not Chief Information Officer)?
