July last week: Approval notice sent
August first week: approval notice received
Documents requested for RFE (also suggested by lawyer):
- Client Letter, role/responsibilities, duties, technologies used, company profile etc.
This letter also clearly stated all entities involved and their relationships with each other.
- Purchase Order and Other contract related stuff (all possible). Everyone co-operated.
- Badge (main bulding, her office), timesheets
- photos (cubicle/office building,company logo etc), login screen, machine etc, client phone directory
- copies of recent pay stub and offer letter, job duties
Thanks to everyone who contribute on this forum. It helped us a lot. This is for my wife.

I received my receipts today for 140, 485, EAD and AP from NSC.
Application was sent out on 8/8/07.
Received on 8/9/07.
Notice date on 9/20/07
Checks cashed on 9/21/07
Receipts received on 9/27/07.

Are you telling it because of 2 year home residency rule and getting waivers?

I have approved I140 (EB3, PD:Nov'04) from previous employer; after getting my MBA (Jun'06), I have changed the job and my job description has also changed. New employer will file the labor after 3 months (HR Policy)..I have good relations with previous employer, they are ready to file I485. Is it possible to file I485(previous employer), while I am working with new employer?
I am not sure but I came to know (not reliable source), that it is possible to file I485(previous employer) and during the interview, I can submit a support letter from the new employer. is this correct?

Here is my situation. greatly aprecite if you could give some suggestions.
I am presently on Non-cap H1b(which is not counted under cap). I am planning to file for H1b thru an employer in april under MS quota with a start date of octber 2008.
My concerns are...
1. How should the new employer file H1b so that I can join at my wish after oct 2008...??
2. My present H1b is valid untill 2010. SHould I be in US while filing and untill my new H1b is approved..??? I ahve plans of visisitng india in March/aprial. don't think their is a set time required. I know people that left their employer the day after gc arrived, know people that left 6 months after their approval and some that have worked for their employer even after receiving their green card for over 4 years. hope this helps

Hi,
My spouse was on H1, the applied for H4 which was approved but he start date was incorrect, so an I102 was applied to get the I-94 corrected , we got the dates incorrect again so the lawyer applied for correct of dates again (October 2010). This whole thing has been going on for an year now.
In the mean time, we had a family emergency and my wife had to go to India , She went on a valid AdvanceParole. ( We have a pending 485 , so got an AP also)
Today we received a mail from USCIS, asking her to attend an interview regarding this I-94 replacement.
. She is not in US
. She submitted all the I94 cards she had at the Aiport
1. Will she have any problem coming back. She was always on Status. NO issues there
2. Is there any way to postpone the interview ?
3. Does it affect my I-485
4. What is the best course of action

I understand the wages lesser than specified in Labor is a real potential issue. But what about wages much higher than specified? 10-20% increase will be fine, but what about 50% or 100% jump.
Many of us live in consulting world and in a billing sharing mechanism where your annual wages fluctuates. I am talking to a potential client which can give me a significant raise (please note I am not transferring H1 or using EAD and will be staying with the same GC filing company with 140 approved and 485 pending).

Today, I received an email saying that "Notice Returned as Undeliverable" only for my spouse. We have not changed the mailing address and we are not expecting any docs from USCIS.
Question:
1. Who screwed up? Is it USPS or USCIS?
2. What notice could this be?
3. How would I resolve this (From a quick search, it appears that simply giving customer service a call will not help)

My H1 expires in march 2009, I have valid EAD and AP, I want to renew my H1to be on the safer side.
My wife made use of her EAD for few months and now she is not working, and we are planning to visit India for few weeks next year and get H1 and H4 stamped.
here are my questions:
1. Can my wife get her H4 extension when I apply for my H1 extension ?
2. Does USCIS know that she used her EAD (Is there a way that they can find out) and will there be any problem in approving H4 extension ?
3. Now that she is not using her EAD, Is she back on H4 status ? She came here as H4 and never made a trip back.

I m without an assignment for about 3 months, but I m maintaining my status bcoz the employer is running the payroll with minimum salary. mean while i m expecting a full time offer from a company and they are willing to transfer the visa. so my question is that when the new company will be asking for the paystubs for the transfer, I have the paystubs which have a reduced(minimum) salary than what I was earning when I had a project, so will it affect my job offer or any questions will be asked by USCIS?
i know the questions are pretty open, I would appreciate any replies/advice on this,
